What this covers

darkeffekt.com, the plugins and Unity packages we sell, and Brightmaxxer for iOS.

The site has no accounts, cart, or comments. You can download a free trial, write to us through the contact form, and, if you choose, join a mailing list; buying happens on a storefront we link to, or in the app through Apple, never on this site.

The website

Analytics

We use Google Analytics, provided by Google LLC, gated on your choice in the cookie banner. In the EEA, the UK, and Switzerland our legal basis for it is your consent, and we do nothing with it until you give it.

Before you choose, or if you decline, it stores nothing on your device and Google receives a page view carrying no identifier between visits. If you accept, it also sets cookies expiring within two years, so repeat visits register as the same browser.

Either way, Google receives your IP address. Analytics never shows the address to us. Advertising and remarketing features are permanently disabled. How Google handles data from sites that use its services is described at policies.google.com/technologies/partner-sites.

Withdraw consent at any time through Cookie preferences in the footer. Your choice is stored in your browser and sent to nobody.

Downloading the trial

The trial download asks for nothing. When you reach the download page, we record the time, the page that referred you, and any campaign tags or ad click identifiers in the link you followed (the utm_ parameters an ad or newsletter adds, and Meta's or Google's click id). That is how we see which links and ads bring people to the trial, which is our legitimate interest in knowing where to spend. Nothing on the page is stored in your browser.

The mailing list

A box on the download page and at the foot of our product pages joins our mailing list, and it is the only thing on the download page that takes an email address. Enter an address in it and we email you product updates and announcements; that is on the basis of your consent, which we record by storing the address, that you asked, when, and which page you asked from. Every marketing email has a one-click unsubscribe, and you can also ask us to stop at any time.

Correspondence

If you write to us, we keep the message and your address. Our legal basis is our legitimate interest in answering people who write to us. Our Discord server runs under Discord's privacy policy, not this one.

The contact form is ours: what you send is stored in our own records and emailed to us. We keep the topic, your name and address, the subject, the message, and which page you sent it from.

The form runs a check in your browser to keep out bulk mail. It involves no third party and stores nothing on your device.

The software

Plugins and Unity packages

They collect nothing, contain no analytics, and make no network calls of any kind, including licensing and update checks. Audity's profiling tools write only to your own machine.

GrindSub keeps its trial clock and your license in a settings file on your own computer. It also stores small markers on your machine whose names are derived from an identifier for that machine. That derived value is worked out and used entirely on your own computer, only to place and find those markers; it is never sent anywhere, never written into your license, and never tied to any account.

Brightmaxxer for iOS

Brightmaxxer asks for your photo library so you can pick a photo or clip to add glow to, and so it can save the result back to your roll. It opens only what you pick.

Everything the app does to a photo or clip happens on your iPhone. Nothing you open in it reaches us or anyone else, nothing is uploaded or backed up by us, and there is no account and no sign-in. The app collects nothing, contains no analytics, and does not track you. We receive no data from it. It remembers on your phone that you have seen the intro, and deleting the app removes that.

Long Clips is an in-app purchase, so the app asks Apple for its price and whether you already own it. That is its only connection, and it is to Apple rather than to us; see Buying our software.

Buying our software

We sell through storefronts, and each one is the seller of record and a controller of your data in its own right, under its own privacy policy rather than this one. We never receive your card or bank details from any of them.

Through the Unity Asset Store, the transaction is Unity's and we receive no contact details for you. If you contact support we may ask for your invoice number to confirm a purchase, and we keep it with the conversation.

Brightmaxxer's Long Clips in-app purchase is sold by Apple, and the transaction is Apple's under Apple's privacy policy. Apple holds your payment instrument and records that you own it. We receive no contact or payment details for you, and nothing that identifies you.

Some of our products are sold through Stripe, which is the seller of record. Stripe holds your payment instrument. We receive from Stripe, and keep in our own record of the order, the name you give for the license, your email address and billing country, the product, the license, and Stripe's identifiers for the session and payment. We use that to deliver the software, to re-send a lost license, to answer you about your purchase, and to keep the sales records tax law requires of us. Processing it is necessary to perform our contract with you, and keeping the records is a legal obligation. Your license is also written onto the payment record at Stripe. The same applies to any other reseller we authorize.

Ad measurement

We advertise on Meta and Google. If you arrive from one of our ads, the link carries a click identifier, and if you then download a trial or buy, that identifier travels with the download or the order.

When you download a trial, our store tells Meta Platforms, Inc. that a trial started, with the click identifier from the link you followed. When a purchase completes, it tells Meta that a purchase happened, with the click identifier, the amount, and your email address and country in hashed form. Either way Meta can tell which ad led to it, and uses this to measure and improve our ads under its own privacy policy. We do this on the basis of our legitimate interest in knowing whether our advertising works, wherever you are. For purchases billed to the United States it is sent under Meta's Limited Data Use terms. For Google, we upload the click identifier, the time, and the amount of each purchase, with no personal details, to Google Ads.

To object, write to us before or after downloading or buying and we will not report it, or will ask Meta to remove it.

What we do not do

• We do not sell personal information. The only disclosure for advertising is the purchase measurement under Ad measurement; we do not share personal information for cross-context behavioral advertising or targeted advertising beyond it.
• No advertising trackers on this site, and none in our software.
• No profiling, automated decision-making, or identification of individual people.
• No social widgets, chat popups, or session recorders.

Providers

We use third parties to host the site, deliver mail, and run analytics. They process data only on our instructions. The site, the store, and its records run on Microsoft Azure in the United States. Analytics is Google Analytics, described under Analytics. Transactional mail, the license and a contact message on its way to us, goes through Azure Communication Services. Our mailing list runs on Mailchimp, which holds the address of anyone who opted in and handles the unsubscribe. Storefronts are controllers in their own right; see Buying our software.

When we disclose data

Only when the law requires it, to establish or defend a legal claim, to the providers so they can do their job, or to Meta and Google as described under Ad measurement. If the business is sold or transferred, correspondence and analytics data go with it and this policy continues to apply to them.

Retention

Analytics data, 14 months. Correspondence, until the matter is closed and for up to two years after the last message, longer only if needed for a legal claim or a security disclosure record. Purchase records, for as long as tax and accounting law requires us to keep them, which is seven years. Trial download records, the time, referrer, and campaign data recorded with them, for up to two years so we can measure whether our links and ads worked. If you joined the mailing list, we keep your address on it until you unsubscribe or ask us to remove you. Your cookie choice, until you clear this site's data.

Where data goes

Processing happens in the United States; we, our hosting, mail, analytics, and ad measurement providers, and the storefronts we sell through are US entities. Transfers from the EEA, the UK, and Switzerland rely on the EU-US Data Privacy Framework (and its UK and Swiss extensions) where the provider is certified under it, and otherwise on the standard contractual clauses and equivalent safeguards those providers maintain.

Your rights

Depending on where you live: to ask what personal data we hold about you, to receive a copy, to have it corrected or deleted, to object to or restrict its use, and to withdraw consent. Write to contact@darkeffekt.com. We may ask you to confirm you are who you say you are. We respond within 30 days, at no cost, and exercising a right changes nothing about how you are treated. If a request is unusually complex we may take longer and will tell you why. EEA and UK residents may also complain to their local supervisory authority.

Children

The site and our software are not directed at children. If we learn we hold information from someone under 16, we delete it.

Changes

If what we collect changes, this page changes with it and the date above moves. A material change to how consent works resets the banner.
