Terms

These terms cover use of darkeffekt.com, including the Audity documentation under /audity/docs/. They are an agreement between you and DarkIdentity, LLC, a Delaware limited liability company trading as DarkEffekt. By using the site you accept them. If you do not, do not use the site.

Not the software license

Audity is distributed under the Unity Asset Store End User License Agreement, which governs what you may do with the package. Nothing here adds to it, narrows it, or replaces it. Where a separate written agreement exists between you and DarkEffekt, that agreement governs.

Site content

The text, images, layout, name, and logotype belong to DarkIdentity, LLC. Linking and quoting are permitted; wholesale republication is not, nor is use of the DarkEffekt or Audity names and marks in a way that suggests we made or endorsed something we did not.

Documentation

Provided as-is and versioned per release. It may lag the code and it may be wrong.

Acceptable use

Do not attack the site or use it to attack others, degrade it for other visitors, probe non-public parts of the server, scrape it at a rate that affects other visitors, or represent yourself as us.

Security research

Good-faith security research on darkeffekt.com is not a breach of the section above, provided you:

• report to support@darkeffekt.com and allow a reasonable window to fix the problem before publishing;
• do not access, modify, or retain data that is not yours beyond what is needed to demonstrate the problem;
• do not degrade the site for other visitors or run denial-of-service tests;
• do not use social engineering, physical attacks, or attacks on our providers, on Unity, or on Discord. Their systems are not in scope and are covered by their own policies.

We will not pursue a claim against you for research that stays within these limits. This does not bind third parties.

Third-party links

We link to the Unity Asset Store, to Discord, and to other third-party sites. We do not control them and are not responsible for them; their terms apply when you are there. Some Asset Store links may earn us a commission through Unity's affiliate program, at no extra cost to you. Where a link does, it is disclosed at the link.

Unity trademarks

This website is not sponsored by or affiliated with Unity Technologies or its affiliates. Unity is a trademark or registered trademark of Unity Technologies or its affiliates in the U.S. and elsewhere.

No warranty

The site and everything on it are provided as-is and as-available, without warranty of any kind. To the fullest extent the law allows, we disclaim all warranties, express or implied, including accuracy, merchantability, fitness for a particular purpose, and non-infringement. Any part of the site may change or become unavailable without notice.

Liability

To the fullest extent the law allows, DarkIdentity, LLC is not liable for indirect, incidental, special, or consequential losses, or for lost profits, data, or goodwill, arising from use of this site or from reliance on anything published here, and our total liability for anything else arising from the site is limited to one hundred US dollars. Nothing here limits liability for fraud, for death or personal injury caused by negligence, or any other liability that cannot lawfully be limited, and an exclusion a jurisdiction disallows does not apply there. Liability for the Audity software is governed by the Asset Store EULA.

Governing law

These terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules. Venue is the state or federal courts located in Washington. Consumers keep the mandatory protections of the country they live in, and the right to bring a claim where that law allows.

General

If a part of these terms is unenforceable, the rest still applies. Not enforcing a term is not a waiver of it. You may not assign these terms; we may assign them to a successor of the business. These terms and the documents they link to are the whole agreement about use of the site.

Changes

These terms may be revised. The date above is the last revision. Continued use accepts the revised version.
